PURPOSE
These Terms and Conditions of Sale (TCS) define the rights and obligations of ParetoPhysio and its clients in connection with the sale of products and services related to wellness, longevity, performance optimization, and health enhancement.
These TCS apply to all orders placed worldwide, whether directly on ParetoPhysio’s website, by written quotation, or through authorized partners and distributors.
DEFINITIONS
Client: Any individual or legal entity purchasing products or services from ParetoPhysio.
Products: All physical goods, including OxyTap, biological tests, PEMF devices, supplements, and other equipment.
Services: Any consulting, coaching, analysis, or longevity optimization programs offered by ParetoPhysio.
Partner/Distributor: Any third party authorized to resell or promote ParetoPhysio products or services.
Website: www.paretophysio.com and any affiliated domains or subdomains.
SCOPE OF PRODUCTS AND SERVICES
ParetoPhysio designs, develops, and distributes innovative wellness and biohacking products and services including, but not limited to:
Biological and epigenetic tests (DNA, methylation, DECODE, etc.)
Longevity and wellness devices (OxyTap oxygenation system, PEMF, HBOT, EWOT, infrared therapy, etc.)
Nutritional supplements and formulations
Personalized consulting and performance optimization programs
Online and in-person training, workshops, and educational content
All descriptions, visuals, and specifications on the website or quotation documents are for reference only and may be modified at any time without notice.
ParetoPhysio’s products are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease.
ORDER PROCESS
Orders can be placed through:
The ParetoPhysio website
A formal quotation or invoice approved by the client
Authorized distributors or resellers
By placing an order, the client acknowledges full and unconditional acceptance of these TCS.
ParetoPhysio reserves the right to refuse any order that appears abnormal, fraudulent, or contrary to its commercial interests.
PRICING AND PAYMENT TERMS
Prices are indicated in euros (€) inclusive of all applicable taxes for individual clients and exclusive of tax (HT) for professional clients.
For international sales, prices may be quoted in other currencies depending on region or distributor.
Accepted Payment Methods:
Bank transfer
Credit/debit card (Visa, MasterCard, American Express, etc.)
Secure payment link (Stripe, PayPal, etc.)
Cryptocurrency (subject to prior approval)
All payments must be completed before shipment or service execution.
Any delay in payment will result in automatic late fees calculated at 10% above the applicable legal interest rate, plus a fixed recovery fee of €40.
DELIVERY AND SHIPPING
Products are shipped to the address provided by the client during purchase. Shipping times depend on destination, product availability, and customs regulations.
Once the product is handed to the carrier, the risk of loss or damage transfers to the client. ParetoPhysio cannot be held responsible for shipping delays caused by customs, strikes, or force majeure.
Shipping fees, customs duties, or import taxes are the sole responsibility of the client.
RIGHT OF WITHDRAWAL AND RETURNS
In accordance with international consumer protection standards, clients may exercise a 14-day right of withdrawal from the date of delivery.
However, this right does not apply to:
Sealed or personalized products once opened (e.g., DNA or DECODE tests)
Perishable goods (e.g., nutritional supplements)
Digital services or consulting once delivered
To be eligible for a refund, returned items must be unused, unopened, and in their original condition. Refunds are processed within 14 days after approval.
WARRANTY
ParetoPhysio products are covered by the legal warranty of conformity and hidden defects as defined by French and European law.
Claims must be made in writing with proof of purchase and detailed evidence of the issue.
This warranty does not apply in cases of misuse, negligence, damage from improper storage, or unauthorized modification of the product.
LIABILITY AND DISCLAIMERS
ParetoPhysio shall not be held liable for:
Physiological or biochemical reactions resulting from product usage
Misinterpretation of test results or data
Failure to achieve expected outcomes
Inappropriate or excessive use of the products or protocols
All recommendations and programs are provided for informational, educational, and preventive purposes only. They do not replace medical advice, diagnosis, or treatment.
The total liability of ParetoPhysio shall never exceed the amount paid by the client for the order concerned.
CLIENT RESPONSIBILITY
Clients agree to use all products and services responsibly and in accordance with the instructions provided.
They acknowledge that ParetoPhysio’s content and advice are not intended to replace consultation with a qualified medical professional. Clients assume full responsibility for their health decisions and agree to consult a physician if they have any pre-existing medical conditions.
DATA PROTECTION AND PRIVACY
ParetoPhysio fully complies with the General Data Protection Regulation (GDPR) and applicable international data privacy laws.
Collected client data is used solely for:
Processing orders and payments
Providing services and customer support
Improving user experience
Data is never shared, sold, or transferred to third parties without explicit consent.
Clients have the right to access, modify, or delete their data by writing to: contact@paretophysio.com.
INTELLECTUAL PROPERTY
All content available on ParetoPhysio’s platforms, including texts, logos, images, videos, protocols, trademarks, and technological processes, is the exclusive property of ParetoPhysio.
Any reproduction, adaptation, or redistribution, whether partial or total, without written authorization is strictly prohibited and may result in legal action.
Partnership or collaboration agreements do not grant intellectual property rights unless explicitly stated.
CONFIDENTIALITY
Both parties agree to maintain strict confidentiality regarding any business, technical, or strategic information exchanged during the course of their relationship.
This obligation remains in force for five (5) years after termination of the commercial relationship.
FORCE MAJEURE
Neither party shall be held liable for failure or delay in performance due to an event beyond its reasonable control, including but not limited to:
Natural disasters, wars, terrorism, pandemics, embargoes, strikes, or network failures.
In such cases, obligations will be suspended until the event ceases or becomes manageable.
TERMINATION
ParetoPhysio reserves the right to suspend or terminate any order, contract, or service without notice in cases of:
Non-payment
Contractual breach
Misuse of the brand or image
Violation of applicable laws or ethical standards
Termination does not release the client from financial obligations already due.
GOVERNING LAW AND JURISDICTION
These Terms and Conditions are governed by French law.
Any dispute relating to their validity, interpretation, or performance shall be subject to the exclusive jurisdiction of the Courts of Paris, France.
In case of translation, the English version shall prevail in international contexts.
AMENDMENTS
ParetoPhysio reserves the right to modify or update these Terms and Conditions at any time without prior notice.
The version in force at the time of order placement shall apply.
ENTIRE AGREEMENT
These Terms and Conditions represent the entire agreement between ParetoPhysio and the client, superseding any prior oral or written communication.
Any deviation from these terms must be explicitly approved in writing by ParetoPhysio.
MEDICAL DISCLAIMER
All ParetoPhysio products, technologies, and programs are for wellness and performance purposes only.
They are not designed to diagnose, treat, or cure any disease, and should never replace medical supervision.
Clients are encouraged to seek advice from a licensed healthcare professional before beginning any new supplement, program, or device use.
